Nature of the Business \u2013 Commercial Intermediary<\/h3>\n\n\n\n<p>2.1 The Company operates as a <strong>commercial intermediary (sales agent)<\/strong> facilitating the purchase of goods from independent third\u2011party suppliers.<\/p>\n\n\n\n<p>2.2 The Company does not manufacture, store, or physically handle the goods offered on the website.<\/p>\n\n\n\n<p>2.3 By placing an order, the Customer authorizes the Company to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Act on the Customer\u2019s behalf to arrange the purchase of goods from a third\u2011party supplier, and<\/li>\n\n\n\n<li>Facilitate shipment directly from the supplier to the Customer.<\/li>\n<\/ul>\n\n\n\n<p>2.4 Depending on the structure of the transaction, the sales contract for the goods may be concluded:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Between the Customer and the supplier, with the Company acting as an intermediary; or<\/li>\n\n\n\n<li>With the Company acting in its own name but sourcing the goods from third\u2011party suppliers.<\/li>\n<\/ul>\n\n\n\n<p>2.5 The Company does not guarantee continuous product availability.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. Orders and Contract Formation<\/h3>\n\n\n\n<p>3.1 Placing an order constitutes an offer to purchase.<\/p>\n\n\n\n<p>3.2 The contract is concluded once the Company confirms the order by email.<\/p>\n\n\n\n<p>3.3 The Company reserves the right to refuse or cancel an order in cases including but not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pricing errors<\/li>\n\n\n\n<li>Suspected fraud<\/li>\n\n\n\n<li>Supplier unavailability<\/li>\n\n\n\n<li>Compliance concerns<\/li>\n<\/ul>\n\n\n\n<p>If payment has already been made, a refund will be issued.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">4. Pricing and Payment<\/h3>\n\n\n\n<p>4.1 Prices are shown in EUR (unless otherwise specified).<\/p>\n\n\n\n<p>4.2 Prices may include or exclude VAT depending on the Customer\u2019s location and applicable EU VAT rules.<\/p>\n\n\n\n<p>4.3 The Company reserves the right to correct pricing errors before order confirmation.<\/p>\n\n\n\n<p>4.4 Accepted payment methods are displayed at checkout.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">5. Shipping and Delivery<\/h3>\n\n\n\n<p>5.1 Goods are shipped directly from third\u2011party suppliers.<\/p>\n\n\n\n<p>5.2 Delivery times are estimates and not guarantees.<\/p>\n\n\n\n<p>5.3 The Customer is responsible for providing accurate shipping information.<\/p>\n\n\n\n<p>5.4 Risk passes to the Customer upon delivery to the address provided.<\/p>\n\n\n\n<p>5.5 If goods are shipped from outside the Customer\u2019s country of residence, the Customer may be considered the importer of record and may be responsible for any applicable import duties or administrative charges.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">6. Right of Withdrawal (EU Consumers)<\/h3>\n\n\n\n<p>6.1 In accordance with Directive 2011\/83\/EU, consumers have the right to withdraw from the contract within <strong>14 days<\/strong> without giving any reason.<\/p>\n\n\n\n<p>6.2 The withdrawal period expires 14 days after the day on which the Customer (or a third party indicated by the Customer) receives the goods.<\/p>\n\n\n\n<p>6.3 To exercise the right of withdrawal, the Customer must notify the Company via email.<\/p>\n\n\n\n<p>6.4 The Customer must return the goods without undue delay and no later than 14 days after notifying withdrawal.<\/p>\n\n\n\n<p>6.5 The Customer bears the direct cost of returning the goods unless otherwise agreed.<\/p>\n\n\n\n<p>6.6 The Company may withhold reimbursement until the goods are received or proof of return is provided.<\/p>\n\n\n\n<p>6.7 The Customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.<\/p>\n\n\n\n<p>6.8 The right of withdrawal does not apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sealed goods unsealed after delivery for health or hygiene reasons<\/li>\n\n\n\n<li>Custom-made or personalized products<\/li>\n\n\n\n<li>Goods clearly used beyond inspection<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">7. Defects and Legal Guarantee<\/h3>\n\n\n\n<p>7.1 Consumers are entitled to statutory rights under EU and Polish consumer protection laws.<\/p>\n\n\n\n<p>7.2 If goods are defective or not in conformity with the contract, the Customer may request:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Repair<\/li>\n\n\n\n<li>Replacement<\/li>\n\n\n\n<li>Price reduction<\/li>\n\n\n\n<li>Contract termination (where legally applicable)<\/li>\n<\/ul>\n\n\n\n<p>7.3 As an intermediary sourcing products from third-party suppliers, the Company may coordinate warranty claims but does not independently manufacture or modify the products.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">8. Limitation of Liability<\/h3>\n\n\n\n<p>8.1 To the maximum extent permitted by law, the Company shall not be liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Indirect or consequential damages<\/li>\n\n\n\n<li>Loss of profits<\/li>\n\n\n\n<li>Business interruption<\/li>\n\n\n\n<li>Loss of data<\/li>\n\n\n\n<li>Compatibility issues<\/li>\n\n\n\n<li>Misuse of products<\/li>\n<\/ul>\n\n\n\n<p>8.2 The Company\u2019s total liability arising from any claim shall not exceed the total amount paid by the Customer for the specific product giving rise to the claim.<\/p>\n\n\n\n<p>8.3 Nothing in these Terms excludes liability that cannot legally be excluded under Polish or EU law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">9. Intellectual Property and Copyright Disclaimer<\/h3>\n\n\n\n<p>9.1 All trademarks, product names, logos, brand references, and product descriptions displayed on the website belong to their respective owners.<\/p>\n\n\n\n<p>9.2 The Company does not claim ownership of third-party intellectual property associated with the products offered.<\/p>\n\n\n\n<p>9.3 Product images and descriptions are provided by suppliers or manufacturers for informational purposes.<\/p>\n\n\n\n<p>9.4 The Company shall not be held liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Copyright infringement<\/li>\n\n\n\n<li>Trademark violations<\/li>\n\n\n\n<li>Patent disputes<\/li>\n\n\n\n<li>Intellectual property claims<\/li>\n<\/ul>\n\n\n\n<p>arising from the manufacture, distribution, or legality of the products supplied by third parties.<\/p>\n\n\n\n<p>9.5 Any intellectual property claims must be directed to the original manufacturer or supplier.<\/p>\n\n\n\n<p>9.6 The Customer agrees to indemnify and hold the Company harmless against claims arising from misuse, resale, or unlawful distribution of purchased goods.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">10. Compliance and Product Use<\/h3>\n\n\n\n<p>10.1 The Customer is responsible for ensuring that purchased goods comply with local laws and regulations in their country of use.<\/p>\n\n\n\n<p>10.2 The Company does not guarantee regulatory compliance in every EU jurisdiction.<\/p>\n\n\n\n<p>10.3 The Customer assumes responsibility for proper installation, use, and legal operation of the products.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">11. Force Majeure<\/h3>\n\n\n\n<p>The Company shall not be liable for delays or failure to perform caused by circumstances beyond its reasonable control, including but not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Supply chain disruptions<\/li>\n\n\n\n<li>Customs delays<\/li>\n\n\n\n<li>Natural disasters<\/li>\n\n\n\n<li>Government actions<\/li>\n\n\n\n<li>Carrier disruptions<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">12. Privacy<\/h3>\n\n\n\n<p>Personal data is processed in accordance with the Company\u2019s Privacy Policy and in compliance with the GDPR (Regulation (EU) 2016\/679).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">13. Governing Law and Jurisdiction<\/h3>\n\n\n\n<p>13.1 These Terms are governed by the laws of the Republic of Poland.<\/p>\n\n\n\n<p>13.2 Any disputes shall be subject to the jurisdiction of Polish courts.<\/p>\n\n\n\n<p>13.3 If the Customer is a consumer residing in another EU Member State, mandatory consumer protection provisions of that country shall apply where required by law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">14. Amendments<\/h3>\n\n\n\n<p>The Company reserves the right to update these Terms at any time.
